Welcome to Kova Haute! These Terms of Service ("Terms") govern your use of our website located at kovahaute.com (the "Site") and your purchase of products from us.

By accessing or using our Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, please do not use our services or make a purchase.

1. Account Terms

• Eligibility: To register an account or complete a purchase, you must be at least 18 years of age or possess the legal capacity to form a binding contract under the Indian Contract Act, 1872.

• Account Accuracy: When creating an account, you agree to provide true, accurate, current, and complete information (such as your full name, active email, phone number, and delivery address).

• Security & Confidentiality: You are responsible for safeguarding your login credentials and password. Any activity conducted under your account is your responsibility. If you suspect unauthorized access, notify us immediately at support@kovahaute.com.

• Account Suspension: We reserve the right to suspend, terminate, or restrict accounts that violate these Terms or provide false or misleading information.

2. Pricing and Payment

• Currency & Taxes: All prices displayed on kovahaute.com are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST), unless expressly indicated otherwise.

• Price Changes: We reserve the right to revise product prices, discounts, or promotions at any time without prior notice. However, once an order confirmation is issued, the price paid for that order remains locked.

• Payment Methods: We accept payments through authorized third-party payment aggregators supporting UPI, Credit Cards, Debit Cards, Net Banking, and select digital wallets.

• Payment Security: We do not collect or store your sensitive card details or banking passwords. All transactions are securely routed through RBI-compliant, PCI-DSS certified payment processors.

• Cash on Delivery (COD): COD is available at no additional handling fee. We reserve the right to disable COD for accounts with frequent rejected or undelivered deliveries.

3. Product Descriptions and Accuracy

• Visual Accuracy: We make every effort to display the colors, textures, and details of our apparel and products as accurately as possible. However, actual colors may slightly vary depending on screen calibrations and display settings of your device.

• Sizing & Measurements: Sizing charts and garment dimensions are provided for reference. Minor tolerances standard to the textile and apparel manufacturing industry may apply.

• Inventory & Availability: Products are subject to availability. While we update stock levels regularly, errors may occur. In the event an item goes out of stock after your order is placed, we will notify you and issue a prompt refund.

4. Order Acceptance and Cancellation

• Order Confirmation: Receiving an electronic order confirmation or receipt acknowledges your order request; it does not constitute a formal acceptance of your order.

• Right to Refuse/Cancel: We reserve the right to refuse, limit, or cancel any order for reasons including, but not limited to:

  • Product unavailability or inventory discrepancies.

  • Errors in pricing, promotional codes, or product listings.

  • Suspected unauthorized, fraudulent, or abusive activity.

  • Incomplete or unverified delivery addresses.

• Cancellation by Customer: You may cancel an order before it has been dispatched from our warehouse by contacting our support team. Once an order is handed over to our courier partner, it cannot be canceled and must be processed under our Return Policy.

5. Shipping and Delivery

• Delivery Timelines: Estimated delivery timeframes are typically 4 to 7 business days, depending on your location, pin code serviceability, and weather or transit conditions.

• Dispatch Notifications: Upon dispatch, a tracking link and Air Waybill (AWB) number will be shared via email and/or SMS/WhatsApp.

• Delivery Attempts: Our logistics partners will attempt delivery up to 2 to 3 times. If a parcel is returned to origin (RTO) due to customer unavailability, incorrect contact details, or refusal to accept without valid reason, re-shipping fees may apply.

• Transit Risks: Risk of loss and title for items pass to you upon delivery to the designated shipping address. Please inspect parcels upon delivery; if a package appears visibly tampered with or damaged, do not accept it and report it to us immediately.

6. Returns, Exchanges, and Refunds

• Return Window: Customers may request a return or exchange within 14 days of receiving the product.

• Condition of Items: To qualify for a return or exchange:

  • Items must be unworn, unwashed, and undamaged.

  • Original tags, brand packaging, hygiene liners, and any included accessories must remain intact.

  • Proof of purchase (order ID or tax invoice) must be provided.

• Non-Returnable Items: Customized items, final sale clearance items, or intimate accessories are non-returnable unless received in a defective or damaged state.

• Refund Processing: Once the returned item passes quality inspection at our facility, refunds will be initiated to the original payment source within 5 to 7 business days. For COD orders, refunds are issued via secure bank transfer or store credit.

7. Prohibited Uses

You agree not to use the Site or its content for any unlawful or unauthorized purpose, including:

• Violating any local, state, national, or international laws or regulations.

• Infringing upon intellectual property, trademark, or copyright belonging to Kova Haute or third parties.

• Uploading or transmitting malicious code, viruses, automated bots, scrapers, or spyware.

• Engaging in abusive conduct, chargeback fraud, or harassment of our customer service representatives.

• Reselling, reproducing, or commercially exploiting products purchased from our Site without explicit written authorization.

8. Limitation of Liability and Disclaimers

• As-Is Basis: Our Site, products, and services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law.

• Indirect Damages: Under no circumstances shall Kova Haute, its owners, directors, employees, or affiliates be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of, or inability to use, our Site or products.

• Maximum Liability: To the maximum extent permitted under applicable law, our total aggregate liability for any claim arising out of your purchase shall be limited strictly to the total purchase price paid by you for the specific product in dispute.

9. Governing Law and Jurisdiction

• Applicable Law: These Terms shall be governed by and construed in accordance with the substantive laws of India, without regard to its conflict of law principles.

• Jurisdiction: Any dispute, controversy, or claim arising out of or relating to these Terms, purchases made on kovahaute.com, or your use of the Site shall be subject to the exclusive jurisdiction of the competent courts located in Mapusa, Goa, India.
